Permanent VisasThe immigration system sets aside a specific number of immigrant visas (or green cards) each fiscal year for the sponsorship of foreign nationals through their employers. In very limited and specific circumstances, a foreign national may petition for himself/herself and does not require an employer to sponsor him/her. Generally, most employment sponsored green card categories require a certified PERM application. The PERM process is administered through the Department of Labor and requires the employer to complete a recruitment process and labor certification process that demonstrates that U.S. workers are not able, available, qualified or willing to fill the position. The employment based immigrant categories (EB classifications) are divided in five categories: EB-1: The EB-1 category is for multi-national managers and executives, outstanding researchers and professors, and foreign nationals with extraordinary ability in their fields of endeavor. EB-2: The EB-2 category is for foreign nationals who have advanced degrees and will be employed in positions which normally require advanced degrees and for foreign nationals who have exceptional ability. If the foreign national's work will benefit the national interest, a waiver of the PERM requirement may be possible. EB-3: The EB-3 category is for foreign nationals who are skilled professionals as well as unskilled workers. All foreign nationals applying for permanent residency through the EB-3 category require the successful completion of the PERM process. EB-4: The EB-4 category is for foreign national who are religious ministers. EB-5: The EB-5 is for entrepreneurs and investors.
