Dallas Family Immigration Concerns

Petitioning for permanent resident status for a family member can be a lengthy process. Factors to consider include: the sponsor's citizenship status, the familial relationship between the person seeking entry and the sponsor, and how the new immigrant will initially be supported.

Types of family-based visas available include:

  • Immediate family members. Immediate family members are eligible for a family-based visa without regard to visa availability. Spouses, unmarried minor children and parents of U.S. citizens are all eligible to petition for a family-based immigration visa.
  • Non-immediate family members/preferences. Non-immediate family members must wait for a visa to become available. These visas are awarded based upon the following preferences: Unmarried adult children of a U.S. citizen (1st preference); unmarried minor children of legal permanent residents (2nd preference, or 2A); unmarried adult children of permanent residents (2nd preference, or 2B); married children of a U.S. citizen (3rd preference); brothers or sisters of a U.S. citizen (4th preference).
  • Fiancés/fiancées: Fiancés of U.S. citizens may come to the United States on a temporary fiancé visa (K-1) in order to be married. We also help clients obtain K-3 and K-4 visas (spouses and spouse's children of U.S. citizens).
