Entrepreneur and Investor Immigration Visas (EB-5)

There are two ways of qualifying for an EB-5 investor visa. While both methods involve sizeable capital investment in a new or existing business in the United States, the requirements for each vary significantly:

  • EB-5 visa ($1 million): In order to obtain an EB-5 investor visa, the foreign national must make an investment that meets certain thresholds set by federal law. The individual must invest $1 million into a new or existing U.S. business that is a benefit to the U.S. economy. However, if the business is located in a "targeted unemployment area" or designated rural area, the investment may be $500,000. The business must create full-time jobs for at least 10 workers in the U.S. In order to qualify for this permanent investor visa, the investor must be in a position to direct and develop the business.
  • EB-5 visa ($500,000): A pilot program in the U.S. allows foreign investors to obtain permanent investor visas after satisfying less stringent requirements. Individuals who invest $500,000 into an approved regional center in the United States may qualify for the EB-5 visa and obtain permanent resident status. Regional centers are preapproved by the government and employment creation may be indirect based upon the methodology of the approved plan.
